ARTICLE 1. ORGANISATEUR

Le Festival du Film Coréen à Paris est organisé par l’Association 1886, une association loi 1901, dont le siège social se trouve 44 avenue de Paris – Bâtiment A3 à CHATILLON 92320 (ci-après « l’Organisateur »). L’Organisateur organise un concours gratuit de courts métrages intitulé « Compétition ShortCuts » (ci-après le « Concours »).

ARTICLE 2. CONDITIONS D’INSCRIPTION AU CONCOURS

2.1. La participation au Concours implique l'acceptation expresse et sans réserve du présent règlement (ci-après le « Règlement »), en toutes ses stipulations, ainsi que des lois et règlements applicables en France. 

2.2. Le Concours est ouvert aux personnes physiques majeures (ci-après le ou les « Participant(s) »), selon les conditions définies au présent article. Sont exclues toutes les personnes physiques mineures, toutes les personnes ayant directement participé à l’élaboration du Festival du Film Coréen à Paris ainsi que les membres de leurs familles (conjoint(e)s, concubin(e)s, ascendants, descendants directs, frères et sœurs).
Le Concours est ouvert aux réalisateurs de nationalité coréenne (sans restriction).
Le Concours est ouvert aux réalisateurs non-coréens avec restrictions, le film soumis devant répondre au moins à l’une des conditions suivantes :

• être tourné en Corée du Sud (ex : mettre en valeur la culture, le paysage, etc.) ;

• avoir comme axe fort la culture coréenne (ex : langue parlée majoritairement dans le film, intégration de la communauté coréenne dans des pays étrangers, etc.).

 2.3. Le Participant ou son représentant (ex : société de distribution) doit s'inscrire sur la plate-forme « www.filmfreeway.com ». Si le Participant ou son représentant souhaite enregistrer plus de 10 (dix) films, l’inscription peut se faire directement par e-mail auprès de l’équipe de l’Organisateur à l’adresse suivante : shortcuts@ffcp-cinema.com. L’enregistrement des inscriptions s’effectue de façon continue à partir du 15/05/2024 jusqu’au 17/06/2024 à minuit, l’heure de la réception de l’enregistrement de l’inscription via la plate-forme ou de l’envoi de l’email faisant foi. Aucun autre moyen de participation ne sera pris en compte.

2.4  Le Participant est informé et accepte que les informations saisies dans le formulaire d’inscription valent preuve de son identité. Les informations saisies par le Participant l'engagent dès leur validation. L’Organisateur se réserve le droit de vérifier l’exactitude des données fournies par les Participants. Le Participant s'engage à compléter de bonne foi le formulaire d’inscription mis à sa disposition et à transmettre à l’Organisateur des informations exactes et non contrefaites. Le Participant doit renseigner l'ensemble des zones de saisie, excepté celles mentionnées comme n'étant pas obligatoires.

2.5. Les participations au Concours seront annulées si elles sont incorrectes, incomplètes, contrefaites ou réalisées de manière contrevenante au présent règlement.

ARTICLE 3. MODALITÉS DE PARTICIPATION AU CONCOURS

 3.1 Chaque Participant (réalisateur principal) est identifié avec ses nom, prénom et adresse. Chaque Participant ou son représentant pourra inscrire autant de films qu’il le souhaite, d’une durée comprise entre 1 (une) et 30 (trente) minutes, générique inclus, sous un format haute définition en version originale. Chaque film doit être fourni avec des sous-titres anglais ou français. Ces sous-titres peuvent être directement incrustés ou fournis dans un fichier indépendant.

Le fichier et les sous-titres en français ou en anglais doivent être partagés avec l’Organisateur par e-mail ou via un lien de téléchargement (ou streaming) avant le 31/08/2024. Les fichiers des sous-titres devront être fournis au format XML, DOC, SRT ou TXT. Tout film ne remplissant pas ces conditions sera exclu du Concours.

Un même film peut être coréalisé par plusieurs Participants. Dans ce cas, l’un d’eux se désignera lors de l’inscription comme « réalisateur principal ». Si le film est lauréat de l’un des prix, le Participant déclaré comme « réalisateur principal » sera seul récipiendaire des prix, et fera son affaire de la répartition avec ses coréalisateurs. L’Organisateur ne pourra être tenu pour responsable des modalités de la répartition entre deux ou plusieurs co-Participants. Le Participant garantit que le film proposé est original et qu'il est le seul détenteur des droits de propriété intellectuelle relatifs à ce film. A ce titre, le Participant fera son affaire des autorisations de tous tiers ayant directement ou indirectement participé à sa réalisation et/ou qui estimeraient avoir un droit quelconque à faire valoir à son égard, notamment leur droit à l’image, et assumera la charge de tous les éventuels paiements en découlant.

Concernant la bande-son, le Participant garantit être l’ayant droit de la musique utilisée dans le film ou d’en avoir acquis les droits nécessaires auprès de l’auteur ou de ses ayant droits. Une attestation pourra être demandée par l’Organisateur s’il le juge nécessaire.

De façon générale, le Participant garantit l’Organisateur du présent Concours contre tous recours, actions ou réclamations que pourraient former, à un titre quelconque, tous tiers, à l’occasion de l’exercice des droits cédés aux présentes, et plus généralement au titre de toutes les garanties et engagements pris au titre du présent Règlement. L’Organisateur se réserve le droit de procéder à toute vérification nécessaire à l’application du présent article.

3.2  Le Participant s'interdit de mettre en œuvre ou de chercher à mettre en œuvre tout procédé de participation qui ne serait pas strictement conforme au respect des principes du Concours et du Règlement.

3.3  L’Organisateur se réserve le droit de disqualifier tout participant qui altère le fonctionnement du Concours ou encore qui viole le Règlement du Concours. L’Organisateur se réserve le droit de poursuivre quiconque tenterait de frauder ou de nuire au bon déroulement du Concours.

3.4  L’Organisateur se réserve le droit de procéder à toute vérification nécessaire à l’application du Règlement, notamment pour écarter tout Participant ayant commis un abus quelconque ou une tentative de fraude, sans toutefois qu'il ait l'obligation de procéder à une vérification systématique de l'ensemble des formulaires d’inscription reçus.

3.5  L’Organisateur se réserve le droit de prolonger, écourter, modifier ou annuler le Concours à tout moment, notamment en cas de force majeure, sans qu’il puisse être prétendu à aucune indemnité par les Participants. 

3.6  L’Organisateur pourra décider d'annuler le Concours ou une participation s'il apparaît que des fraudes manifestes sont intervenues sous quelque forme que ce soit, dans le cadre de la participation au Concours ou de la détermination des gagnants.

3.7 En s’inscrivant au Concours, le Participant s’engage à ce que l’ensemble des contenus inscrits respecte les législations en vigueur, et notamment, sans que cette liste ne soit exhaustive, qu’il :

• respecte les droits de propriété intellectuelle des tiers ;

• ne porte pas atteinte à la réputation, à la vie privée et à l'image de tiers ;

• ne contient pas de contenus liés à un intérêt manifestement commercial ou à but promotionnel ;

• ne présente pas de caractère pédopornographique ;

• ne contient pas de messages ou d’informations à caractère xénophobe ou raciste ;

• n’incite pas à la discrimination, qu'elle soit basée sur le sexe, la religion, la nationalité, l'invalidité, l'orientation sexuelle, l'âge ou les opinions politiques ;

• n’incite pas au crime, à la haine, à la violence, au suicide et au racisme ;

• n’incite pas à commettre un crime, un délit ou un acte de terrorisme.

3.8 Du seul fait de leur participation, les Participants autorisent expressément et à titre gracieux l’Organisateur à diffuser les vidéos sélectionnées dans toute manifestation organisées ou co-organisée par le Festival du Film Coréen à Paris en France pour une durée de 18 (dix-huit) mois à compter de la date d’annonce des Participants sélectionnés.

 ARTICLE 4. SÉLECTION DES FILMS

 4.1.  Tout film inscrit et sélectionné dans le cadre du Concours pourra être retiré de la sélection dans les 15 (quinze) jours suivant l’annonce de sa sélection faite par e-mail par l’Organisateur au Participant. Passé ce délai, le Participant ne pourra plus retirer le film sélectionné. Tout film retiré par le Participant ne pourra plus être soumis à une future sélection. 

4.2 En cas de sélection de son film, le Participant ou son représentant devra obligatoirement fournir le film sous le format suivant :

• Pour les films muets : format DCP (idéalement) et .mov (obligatoire) 

• Pour les films dialogués : format .mov 

Pour les .Mov :

Image :

• Résolution : 1080p ou 2k

• Codec : Apple ProRes 4444, Apple ProRes HQ, ou H264

• Si codec H264 - débit cible : 50Mbits/seconde minimum et 150Mbits/seconde maximum

 Son : 

• Taux d’échantillonnage : 48 000 Hz

• Débits : 192 Kbits minimum

• Canaux : stéréo ou 5.1 (à préciser lors de l’envoi du fichier)

 4.3 En cas de sélection de son film, le Participant ou son représentant devra obligatoirement fournir un fichier de sous-titres en français ou en anglais au format « .srt », « .xls », « .doc » ou « .txt » comprenant les timecodes.

 4.4 Les films sélectionnés peuvent être projetés à plusieurs reprises durant toute la durée de l’édition concernée du Festival du Film Coréen à Paris.

 ARTICLE 5.  PRIX ET DESIGNATION DES LAUREATS

 5.1. Quatre (4) prix seront décernés : 

• Grand Prix : décerné par un jury de 3 (trois) professionnels sélectionnés pour l’édition 2024.

• Prix du Meilleur Scénario : décerné par un jury de 3 (trois) professionnels sélectionnés pour l’édition 2024.

• Prix du Meilleur Film d’Animation : décerné par un jury de 3 (trois) professionnels sélectionnés pour l’édition 2024.

• Prix Étudiant : décerné par un jury de 5 (cinq) étudiants.

Un cinquième prix, le Prix Kids, décerné par le public, pourra être organisé à la discrétion de l’Organisateur si ce dernier estime que la sélection 2024 s’y prête.

Un sixième prix, le Prix Strangecuts, décerné par le public, pourra être organisé à la discrétion de l’Organisateur si ce dernier estime que la sélection 2024 s’y prête.

5.2 Un Participant ne peut pas remporter plus de 2 (deux) prix.

 5.3. Les Participants, du seul fait de leur participation, autorisent l’Organisateur à diffuser leurs films dans le cadre de la promotion du Festival du Film Coréen à Paris. Les lauréats retenus pour les prix décernés seront dévoilés lors de la soirée de remise de prix organisée à l’occasion de la clôture du Festival du Film Coréen à Paris 2024.

 ARTICLE 6.  MISE EN POSSESSION DES PRIX

6.1. Les prix sont attribués nominativement conformément aux informations (nom, prénom et adresse) communiquées par le Participant, ou le « réalisateur principal » en cas de coréalisation, lors de son inscription au Concours. Si les informations ou coordonnées communiquées par le Participant ne permettent pas de l’informer de son gain, il perdra la qualité de lauréat et ne pourra effectuer aucune réclamation.

6.2. Dans le cas où le lauréat serait dans l’impossibilité de bénéficier, en tout ou partie, de son prix, pour quelque raison que ce soit, il en perdra le bénéfice, sans possibilité d’obtenir une quelconque contrepartie. Il sera alors procédé à une nouvelle sélection par le jury parmi les autres Participants.

 ARTICLE 7 : GRATUITÉ DU CONCOURS

 Le Concours est entièrement gratuit, sans obligation d’achat, et n'implique aucune dépense ou sacrifice pécuniaire sous quelque forme que ce soit de la part des Participants.

 ARTICLE 8 : DONNÉES A CARACTERE PERSONNEL

 8.1 Pour participer au Concours, les Participants doivent nécessairement fournir les données à caractère personnel suivantes (ci- après les « Données ») :

• Nom ;

• Prénom ;

• Adresse e-mail ;

• Numéro de téléphone ;

• Adresse postale (numéro de rue, code postal, ville, pays) ;

• Date de naissance ;

• Sexe.

 8.2 L’Organisateur est responsable de la collecte et de l’utilisation des Données qui sont nécessaires à la bonne exécution du Concours et à la remise des prix aux lauréats. 

 8.3. Les destinataires des Données sont les bénévoles autorisés de l’Organisateur. L’Organisateur se réserve le droit de demander à tout Participant des informations complémentaires pour confirmer son identité. 

 8.4 Conformément à la loi du 6 janvier 1978 modifiée dite « Informatique et Libertés » et au règlement européen 2016/679 du 27 avril 2016 dit « Règlement Général sur la Protection des Données », les Participants disposent d’un droit d’accès, de rectification, de modification et de suppression des données qui les concernent. Ils peuvent ainsi exiger que soient rectifiées, complétées, clarifiées, mises à jour ou effacées les informations les concernant qui sont inexactes, incomplètes, équivoques, ou périmées. Ils peuvent également exercer leurs droits d’opposition et de limitation du traitement de leurs données ainsi que leur droit à la portabilité des informations les concernant. Si les Participants souhaitent exercer ces droits, ils peuvent adresser une demande à l’adresse électronique suivante : shortcuts@ffcp-cinema.com. 

 8.5. Les Données ne seront pas conservées au-delà de la durée strictement nécessaire aux finalités poursuivies telles qu'énoncées au présent Règlement. Néanmoins, les Données pourront être conservées avant suppression, en archives intermédiaires, pendant la durée de prescription légale afin de conservation de la preuve de la participation des Participants, de l’envoi des prix ou des garanties consenties au titre du présent Règlement pour la défense des droits de l’Organisateur.

8.6. Transferts internationaux de données à caractère personnel. Du fait du caractère international du Festival du Film Coréen à Paris, vos données à caractère personnel sont susceptibles d’être transférées à des sociétés, entités gouvernementales et à des tierces parties de confiance dans des pays n’appartenant pas à l’Espace Économique Européen et dont les lois sont susceptibles de ne pas offrir le même niveau de protection à vos données à caractère personnel.

 8.7 Le Participant a le droit d’introduire une réclamation auprès de la Commission Nationale de l’Informatique et des Libertés (CNIL), en sa qualité d’autorité de contrôle.

 ARTICLE 9 : LITIGES

9.1 Le fait de participer au Concours et d’avoir coché la case d’acceptation du Règlement lors de l’inscription entraîne l'acceptation pure et simple du Règlement.

 9.2 Aucune réclamation d’aucune sorte ne peut intervenir concernant tout ou partie du concours au-delà d’un délai de 2 (deux) mois à compter de la fin du Concours.

 9.3 Le présent Règlement est soumis à la loi française. En cas de désaccord persistant sur l'application, l’exécution ou l'interprétation du présent Règlement, et à défaut d'accord amiable, tout litige sera soumis au tribunal du siège social de l’Organisateur.

ARTICLE 1. ORGANISERS

The Paris Korean Film Festival is organised by Association 1886, a ‘1901’ non-profit association, registered head office 44 Avenue de Paris – Bâtiment A3, CHATILLON 92320 (the ‘Organisers’). The Organisers are holding a free short film competition entitled ‘ShortCuts Competition’ (the ‘Competition’).

ARTICLE 2. COMPETITION ENTRY TERMS AND CONDITIONS

2.1. Entering the competition implies express and unreserved acceptance of these rules (the ‘Rules’) in their entirety, as well as of all legislation and regulations applicable in France.

2.2. The Competition is open to natural persons aged over 18 (the ‘Participant(s)’), subject to the terms and conditions set out in this article. Underage natural persons, persons who have directly contributed to setting up the Paris Korean Film Festival, and their family members (spouses, domestic partners, ascendants, direct descendants, and siblings) are not eligible for entry. The Competition is open to directors of Korean nationality (without restriction). The Competition is open to non-Korean directors, subject to restrictions: the film entered must meet at least one of the following criteria:

• be filmed in South Korea (e.g. highlight the culture, landscape, etc.);

• have a major focus on Korean culture (e.g. Korean being the majority spoken language in the film, the inclusion of the Korean community in foreign countries, etc.).

2.3  Participants or their representatives (e.g. a distribution company) must register on the  ‘www.filmfreeway.com’ platform. If a Participant or their representative wishes to register more than 10 (ten) films, registration may be carried out directly by email to the Organisers’ team at the following address: shortcuts@ffcp-cinema.com. Registration shall be possible continuously from 15/05/2024 until midnight on 17/06/2024, registration being deemed to have occurred at the time of receipt on the platform or at the time the email is sent. No other means of participation shall be taken into account.

2.4  Participants are informed and agree that the information entered on the registration form shall be deemed to constitute proof of identity. Once they have confirmed this information, Participants shall be committed by it. The Organisers reserve the right to verify the accuracy of the data provided by Participants. Participants undertake to fill in the registration form provided in good faith and to supply the Organisers with information that is accurate and true. Participants must complete all fields marked as mandatory.

2.5. Entries in the Competition shall be null and void if they are inaccurate, incomplete, false, or otherwise contrary to these rules.

ARTICLE 3. COMPETITION ENTRY PROCEDURE

3.1 The details of each Participant (Main Director) shall be supplied in the form of their surname, first name, and address. Each Participant or their representative may enter as many films as they wish, of a duration between 1 (one) and 30 (thirty) minutes including credits, in high-resolution format, in an original-language version. Each film must be supplied with English or French subtitles. The subtitles may be directly embedded or supplied in a separate file.

The file and the French or English subtitles shall be shared with the Organisers by email or an upload (or streaming) link by 31/08/2024. The subtitle files shall be supplied in XML, DOC, SRT, or TXT format.

Any film that does not meet these conditions shall be disqualified from the Competition.

A film may be co-produced by multiple Participants. In this case, one of them shall be designated on registration as the ‘Main Director’. If the film is awarded one of the prizes, the Participant declared as the ‘Main Director’ shall be the sole recipient of the prize, and shall be responsible for how the prize is shared with their co-producers. The Organiser declines any liability for the manner in which prizes are shared between two or more co-Participants.

Participants warrant that any film submitted is original and that they are the sole holder of all intellectual property rights pertaining to this film. In this respect, Participants shall be responsible for obtaining permission from any third parties that have directly or indirectly contributed to its production and/or who may deem that they have any rights in respect thereof, in particular image rights, and shall bear the cost of any payments arising therefrom. In respect of the soundtrack, Participants declare that they own the legal rights to the music used in the film or have obtained the necessary rights from the composer or the latter’s assignees. Proof of this may be requested by the Organisers, should they deem this necessary. In general, Participants shall hold the Organisers of this Competition harmless in respect of any claims, legal proceedings, or complaints that may be brought on any grounds by any third parties regarding the exercise of the rights in question, and more generally in respect of all undertakings and commitments made with respect to these Rules. The Organisers reserve the right to proceed with any verification required pursuant to this article.

3.2  Participants undertake to refrain from using or seeking to use any participation process that does not comply strictly with the principles of the Competition and the Rules.

3.3  The Organisers reserve the right to disqualify any Participant who disrupts proper Competition procedures or breaches the Competition Rules. The Organisers reserve the right to prosecute any person found attempting to act fraudulently or otherwise adversely affect Competition procedures.

3.4  The Organisers reserve the right to proceed with any verification required for application of the Rules, in particular with a view to disqualifying any Participant who has acted improperly or attempted any fraudulent action, without this constituting an obligation on the part of the Organisers to proceed with systematic verification of all registration forms received.

3.5  The Organisers reserve the right to extend, curtail, alter, or cancel the Competition at any time, in particular in the event of force majeure circumstances, without this entailing any entitlement for Participants to claim compensation.

3.6  The Organisers may decide to cancel the Competition or any given entry if it becomes clearly apparent that there has been any form of fraudulent action whatsoever with respect to the Competition entries or the determination of the winners.

3.7 By entering the Competition, Participants warrant that all the content entered complies with legislation in force, this undertaking including, but not limited to warranting that it:

• does not infringe the intellectual property rights of third parties;

• does not damage the reputation, privacy, or image of third parties;

• does not include content linked to a manifestly commercial interest or promotional aim;

• does not constitute child pornography;

• does not include xenophobic or racist messages or information;

• is not an incitement to discrimination, including discrimination on the grounds of sex, religion, nationality, disability, sexual orientation, age, or political opinion;

• is not an incitement to crime, hatred, violence, suicide, or racism;

• is not an incitement to commit a crime, offence, or act of terrorism.

3.8. By participating, Participants expressly authorise the Organisers to broadcast the shortlisted videos free of charge at any event organised or co-organised by the Paris Korean Film Festival in France for a duration of 18 (eighteen) months, commencing on the date on which the shortlisted videos is announced.

ARTICLE 4. SHORTLISTING

4.1.  Any film entered and shortlisted for the purposes of the Competition may be withdrawn from the shortlist within 15 (fifteen) days of the announcement of its selection sent by email to the Participant by the Organisers. Thereafter, Participants may no longer withdraw any shortlisted film. No film withdrawn by a Participant may be submitted for any future selection.

4.2 In the event of their film being shortlisted, the Participant or their representative must supply the film in the following formats:

• Silent films: DCP (ideally) and .mov (mandatory) 

• Films with dialogue: .mov 

.Mov:

• Image resolution: 1080p or 2k

• Codec: Apple ProRes 4444, Apple ProRes HQ, or H264

For H264 codec

• Target bitrate: 50 Mbits/second minimum and 150 Mbits/second maximum

Sound: 

• Sampling rate: 48,000 Hz

• Bitrate: 192 Kbits minimum

• Channels: stereo or 5.1 (to be specified on submission of the file)

4.3 If their film is shortlisted, the Participant or their representative must supply a French or English subtitle file in .srt, .xls, .doc, or .txt format, including timecodes.

4.4 Shortlisted films may be screened multiple times throughout the duration of the Paris Korean Film Festival edition in question.

ARTICLE 5.  PRIZES AND DESIGNATION OF WINNERS

5.1. Four (4) prizes shall be awarded:

• Grand Prix: awarded by a panel of 3 (three) professionals selected for the 2024 edition.

• Best Script prize: awarded by a panel of 3 (three) professionals selected for the 2024 edition.

• Best Animation Film prize: awarded by a panel of 3 (three) professionals selected for the 2024 edition.

• Student prize: awarded by a panel of 5 (five) students.

A fifth prize, the Kids Prize, awarded by the public, may be organised at the discretion of the Organiser if the Organiser deems the 2024 selection to be suitable.

A sixth prize, the Strangecuts Prize, awarded by the public, may be organised at the discretion of the Organiser if the Organiser deems the 2024 selection to be suitable.

5.2 No single Participant may be awarded more than 2 (two) prizes.

5.3. By entering, the Participant authorizes the Organiser to broadcast their film as part of the promotion of the Paris Korean Film Festival. The winners of the prizes will be announced at the awards ceremony organized during the closing of the Paris 2024 Korean Film Festival.

ARTICLE 6.  PRIZE HANDOVER

6.1. Prizes shall be awarded by name, as per the details (surname, first name and address) supplied by the Participant when entering the Competition (or the ‘Main Director’ in the case of co-directed films). Should it prove impossible to inform the winning Participant on the basis of the information or contact details supplied by them, they shall lose their status of winner, with no claim possible in this respect.

6.2. Should it prove impossible for the winner to benefit from all or part of their prize, for any reason whatsoever, they shall lose the benefit thereof; no other alternative shall be made available. In this case the panel shall select another winner from among the Participants.

 ARTICLE 7: NO CHARGE

The Competition shall be entirely free of charge, with no purchase necessary; it does not entail any expenditure or monetary commitment of any form whatsoever by Participants.

ARTICLE 8: PERSONAL DATA

8.1 To enter the Competition, Participants must supply the following personal data (the ‘Data’):

• Surname

• First name

• Email address

• Telephone number

• Postal address (street number, post code, town/city, country)

• Date of birth

• Gender.

8.2 The Organisers shall be responsible for collecting and using the Data for the purposes of holding the Competition and awarding the prizes to the winners.

8.3. The Data recipients are the Organisers’ authorised volunteer workers. The Organisers reserve the right to request additional information from Participants to confirm their identity.

8.4 Pursuant to the amended French Data Protection Act (Loi Informatique et Libertés) of January 6, 1978, and Regulation (EU) 2016/679 of April 27, 2016 (General Data Protection Regulation, GDPR), Participants have the right to access, rectify, amend, and/or delete their personal Data. Consequently, they may demand the rectification, completion, clarification, updating, or deletion of any of their personal Data that is inaccurate, incomplete, ambiguous, or out of date. They may also exercise their rights to oppose and/or restrict the processing of their Data, as well as their right to its portability. Participants wishing to exercise these rights may send a request to the following email address: shortcuts@ffcp-cinema.com. 

8.5. The Data will not be retained beyond the duration strictly necessary for the purposes set out in these Rules. Nevertheless, to protect the rights of the Organisers, the Data may be kept in intermediate archives prior to deletion until such time as any relevant statute of limitations expires, as proof of the Participants having taken part, the distribution of the prizes, and/or the undertakings made pursuant to these Rules.

8.6. International transfers of personal Data. Due to the international nature of the Paris Korean Film Festival, personal Data may be transferred to companies, government bodies, and trusted third parties outside the European Economic Area, whose legislation may not provide an equivalent level of protection for this personal Data.

8.7 Participants are entitled to make any relevant complaint to the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés – CNIL).

ARTICLE 9: DISPUTES

9.1 Entering the Competition and checking the box to accept the Rules on registration entails complete acceptance of the Rules.

9.2 No claim of any nature may be made regarding all or part of the Competition any later than 2 (two) months after the end of the Competition.

9.3 These rules are governed by French law. In the event of any persistent disagreement regarding the application, performance, or interpretation of these Rules, and failing an out-of-court agreement, any dispute shall be brought before the court with jurisdiction for the locality in which the registered head office of the Organisers is situated.

조항 1. 주최기관

파리한국영화제는 44 Avenue de paris, Bâtiment A3, CHATILLON 92320에 위치한 비영리단체 ‘1886 협회’ (이하 주최측) 가 주관하는 행사이다. 주최측은 «숏컷 경쟁부문»이라는 무료 단편 영화 작품 공모를 진행한다.

조항 2. 출품 자격

2.1  출품은 다음의 출품규정(이하 출품규정) 준수를 기본으로 하며, 출품규정의 모든 조항은 프랑스 내 법적 효력이 있다.

2.2  출품은 모든 성인(이하 참가자)에게 열려있으며, 아래 조건을 준수해야 한다. 미성년자, 파리한국영화제 내부 관계자, 주최측과 가족 관계가 있는 경우는 제외한다.

대한민국 국적을 가진 연출자의 작품은 특별한 제한 없이 출품할 수 있다.

대한민국 외 국적의 연출자는 조건 하에 작품을 출품할 수 있는데, 작품이 아래의 조건 중 하나 이상에 해당되어야 한다.

• 한국에서 촬영이 된 경우 (한국 문화나 경관 등)

• 한국문화를 중요한 핵심 주제로 다루는 경우 (영화 내에서 전반적으로 한국어 사용, 해외에서 지내는 한국인 사회를 다루는 등)

2.3  참가자 혹은 그 대리인(배급사 등)은 필름프리웨이 « www.filmfreeway.com » 플랫폼을 통하여 출품을 진행하여야 한다. 만일 참가자 혹은 그 대리인이 10편 이상의 영화 제출을 원할 경우, 출품은 다음 주소의 이메일« shortcuts@ffcp-cinema.com »을 통해 숏컷부문 담당자에게  직접 등록할 수 있다. 작품 등록은 2024년 5월 15일 (월)부터 2024년 6월 17일 (일) 자정까지 (필름프리웨이 플랫폼에 등록된 날짜와 시간, 이메일 수신 날짜와 시간을 기준) 계속해서 진행한다.

2.4  참가자는 신청서에 개인정보 제공을 안내받고, 이에 동의한다. 참가자가 제공하는 정보는 동의와 함께 책임이 따르며, 주최측은 참가자가 제공한 정보의 정확성을 확인할 권리가 있다. 참가자는 제공받은 신청서를 성실히 작성하고, 주최측에 허위 정보가 아닌 정확한 정보만 제공할 것을 약속한다.

2.5  부적절하거나, 미비하거나, 왜곡되었거나, 현 규정에 위반된 방식으로 출품한 경우, 경쟁부문 참가는 무효화될 수 있다.

조항 3. 경쟁부문 참가 방식

3.1  각 참가자(대표 연출자)의 신원은 이름, 성, 주소를 통해 확인한다. 각 참가자 혹은 그 대리인은 갯수의 제한 없이 원하는 만큼의 작품을 제출할 수 있다. 러닝타임은 크레딧을 포함하여 1분에서 30분 사이여야 하고, 고화질의 원본이어야 한다. 또한 모든 작품은 영어 또는 프랑스어 자막이 있어야 하며, 영상에 삽입되어 있거나 별개의 자막파일로 함께 제출해도 무관하다.

영상파일 및 영어 또는 프랑스어 자막은 숏컷부문 담당자와 이메일 혹은 다운로드 링크 등의 방식을 통해 2024년 8월 31일 자정 전까지 제출되어야 한다. 자막파일의 형식은 XML, DOC, SRT 또는 TXT 확장자 파일로 제출되어야 한다. 상기 조항들을 모두 이행하지 않는 영화들은 경쟁부문 참가에서 제외된다.

여러 참가자에 의해 공동 연출된 작품을 출품할 수 있다. 이 경우 한 명의 «대표 연출자»를 지정해 출품을 진행한다. 공동 연출된 영화가 수상을 할 경우 «대표 연출자»가 단독으로 수상하며, 공동 연출자들과의 분배는 이후 개별적으로 진행한다. 주최측은 시상 이후 둘 이상의 공동 연출/참가자들 사이의 분배 방식에 대해 책임 소재가 없다. 참가자는 출품한 영화가 창작물이며, 해당 영화에 관련된 지적 재산권의 유일한 소유자임을 보증한다. 이와 관련해서 참가자는 직/간접적으로 제작에 참여했거나 영화와 관련하여 초상권 등의 권리를 행사할 수 있다고 여겨지는 모든 제 3자의 동의를 얻고, 추후 발생할 수 있는 모든 금전적 책임을 진다.

음원의 경우 참가자는 영화에 사용된 모든 음악의 사용 권한이 있거나, 작가에게 필요한 저작권이나 사용 권한을 취득하여야 한다. 필요시 주최측은 증명서를 요구할 수 있다. 참가자는 제 3자가 제기할 수 있는 청원, 소송, 고소 등으로부터 본 경쟁부문 공모의 주최측이 본 규정에 지정된 권리, 또는 더 일반적으로 본 출품규정에 따라 이루어진 모든 보증 및 약속을 행사할 수 있도록 보호하여야 한다. 주최측은 현 조항의 적용에 필요한 모든 검증을 진행할 권리가 있다.

3.2  참가자는 출품규정의 원칙을 준수하지 않는 참여 방법을 사용하거나 시도할 수 없다.

3.3  주최측은 참가 진행 방식을 왜곡하거나, 규정을 준수하지 않는 참가자를 탈락시킬 권한이 있다. 주최측은 부정행위를 시도하거나 경쟁 부문의 원활한 진행을 방해하려는 사람을 기소할 권리가 있다.

3.4  특히 어떤 종류의 남용이나 부정행위를 시도한 참가자를 제외시키기 위해서 주최측은 현 출품규정의 적용에 필요한 모든 검증을 진행할 권리가 있다. 하지만 접수된 모든 등록 양식에 대한 체계적인 검증을 수행 할 의무가 없다.

3.5  불가항력적인 경우 주최측은 참가자로부터 보상 청구 없이 언제든지 경쟁부문을 연장, 단축, 변경 또는 취소할 수 있는 권리가 있다.

3.6  경쟁부문 참가 과정이나 작품선정 과정 중 어떠한 형태로 부정 행위가 발생할 경우 주최측은 경쟁부문 진행이나 출품을 취소할 수 있다.

3.7  참가자는 출품하면서 등록된 모든 내용이 현행법, 특히 아래와 같은 사항에 준수됨을 약속한다. 아래 목록은 불변의 최종본이 아니다.

• 제 3자의 지적 재산권을 준수한다.

• 제 3자의 명예, 사생활, 초상권을 침범하지 않는다.

• 상업적 이해관계의 내용 혹은 홍보를 목적으로 한 내용을 포함하지 않는다.

• 소아성애 음란물적 성격을 띄지 않는다.

• 외국인 혐오나 인종차별적 성격의 의견이나 정보를 포함하지 않는다.

• 성별, 종교, 국적, 장애, 성적 지향, 나이, 정치적 의견 등 어떤 부분에서든 차별을 선동하지 않는다.

• 범죄, 혐오, 폭력, 자살, 인종주의 등을 선동하지 않는다.

• 범죄행위, 범법행위, 테러행위 등의 자행을 선동하지 않는다.

3.8  참가자는 공모전에 참가함으로써 선정 영화들 발표일로부터 18개월 동안 파리한국영화제가 주최하거나 공동으로 주최하는 모든 행사에 선정 된 영화들이 무료로 상영되는 것에 동의한다.

조항 4. 작품 선정

4.1  경쟁부문에 출품하여 선정된 작품은 주최측이 참가자에게 보낸 본선 진출 발표 안내 이메일을 기준으로 15일 이내에 철회할 수 있다. 그 이후에 참가자는 본선 진출을 철회할 수 없다. 참가자가 철회한 작품은 추후에 경쟁부문에 재출품할 수 없다.

4.2  본인 작품이 본선에 진출한 경우 참가자 혹은 대리인은 반드시 아래 포맷의 영상파일을 제공해야 한다.

• 무성 영화의 경우 : DCP(권장)와 .mov(필수)

• 그 외 영화의 경우 : .mov

.mov 파일의 경우 :

영상

• 해상도 : 1080p 또는 2k

• 코덱 : Apple ProRes 4444, Apple ProRes HQ 또는 H264

• H264 코덱의 경우, Target bitrate : 50Mbits/second minimum 과 150Mbits/second maximum

사운드

• Sampling rate : 48 000 Hz

• Bitrate : 192 Kbits minimum

• Channels : stereo 또는 5.1 (제출 시 정확히 명시)

4.3  작품이 선정되었을 경우 참가자 혹은 그 대리인은 영화 타임코드를 포함한 프랑스어 또는 영어 자막을 필수적으로 .srt, .xls, .doc 또는 .txt 포맷 파일로 제출해야 한다.

4.4  선정된 작품들은 그 해 파리한국영화제의 관련 행사에서 다수 상영될 수 있다.

조항 5. 시상과 수상자 지정

5.1  네 종류의 시상이 이루어진다.

• 그랑프리 상 : 2024년 파리한국영화제가 선정한 전문 심사위원 3명(이하 심사위원단)에 의해 선정된다.

• 최우수 시나리오 상 : 심사위원단에 의해 선정된다.

• 최우수 애니메이션 상 : 심사위원단에 의해 선정된다.

• 학생 심사위원단 상 : 학생 심사위원 5명에 의해 선정된다.

관객이 수여하는 다섯 번째 상인 SHORTCUTS KIDS (단편 어린이 관객상)는 참여작들 가운데 해당 섹션과 적합한 작품이 있을 경우, 주최측의 재량에 따라 선정 및 수상이 진행된다.

관객이 수여하는 여섯 번째 상인 STRANGECUTS (단편 어린이 관객상)는 참여작들 가운데 해당 섹션과 적합한 작품이 있을 경우, 주최측의 재량에 따라 선정 및 수상이 진행된다.

5.2  한 참가자는 두 개 이상의 상을 수여받을 수 없다.

5.3  참가자들은 영화제에 참가함으로써 파리한국영화제 주최 행사에서 그들의 작품을 상영하는 것을 허가한다. 시상과 수상자는 2024년 파리한국영화제 폐막식에서 공개된다.

조항 6. 상의 소유권

6.1  공모전에 응모 시 참가자(공동 연출의 경우 «대표 연출자»)가 제공한 정보(성, 이름, 주소)에 따라 수상이 이루어진다. 참가자가 제공한 정보나 연락처로 수상 사실을 전달할 수 없는 경우, 참가자는 수상 자격을 박탈당하며 이에 항의할 수 없다.

6.2  어떤 이유에서든 수상자가 부분적 또는 전체적으로 수상을 할 수 없는 경우 혜택을 잃게 되며, 수상 상품 또한 받을 수 없다. 따라서 심사위원은 다른 참가자들 사이에서 새로 심사를 진행한다.

조항 7. 무료 공모전

경쟁부문은 어떠한 구매도 필요 없는 전적으로 무료 행사이며, 어떠한 형태로든 참가자에게 지출이나 금전적인 희생을 요구하지 않는다.

조항 8. 개인 정보

8.1  공모전에 응모하는 참가자는 반드시 다음의 개인 정보(이하 정보)를 제공해야 한다:

• 성

• 이름

• 이메일 주소

• 전화번호

• 주소 (도로명주소, 우편번호, 도시, 국가)

• 생년월일

• 성별

8.2  주최측은 경쟁부문의 순조로운 진행과 수상자 시상에 필요한 정보의 수집 및 이용에 있어 책임을 진다. 

8.3  정보의 이용자는 주최측으로부터 허가를 받은 자원활동가들이다. 주최측은 모든 참가자에게 신원 확인을 위해 추가 정보를 요청할 권리가 있다. 

8.4  1978년 1월 6일 «정보 및 자유» 개정 법률 및 2016년 4월 27일의 2016/679 «개인 정보 보호 규정» 유럽 규정에 따라, 참가자는 본인의 개인 정보를 열람, 정정, 변경, 삭제할 권리가 있다. 따라서 참가자는 부정확, 불완전, 불확실하거나 더이상 해당되지 않는 정보들에 대해 수정, 보완, 명료화, 최신화하거나 파기를 요청할 수 있다. 또한, 본인의 개인 정보에 대하여 정보 이용 이의 신청권, 이용 제한권 및 정보 회수권을 행사할 수 있다. 해당 권리를 주장하고자 하는 참가자는 다음의 메일주소로 요청할 수 있다 : shortcuts@ffcp-cinema.com .

8.5  정보는 본 출품규정에 명시된 목적에 필요한 기간이 지나면 더이상 보관되지 않는다. 그러나 정보는 삭제되기 전 법적 규정 기간 동안 중간 관리 기록물로 보관될 수 있다. 이는 참가자의 출품 사실, 상장 발송 또는 본 출품규정에 따라 주최측의 권리 보호를 위해 참가자가 보증한 내용들에 대한 증거 보관을 위함이다.

8.6  개인 정보의 국가 간 이동. 파리한국영화제의 국제적이라는 특성으로 인해 개인 정보가 유럽경제지역에 포함되지 않는 개인정보 보호 수준이 상이한 국가의 기업, 정부 조직 및 제3 신뢰 기관에 전달될 수 있다.

8.7  참가자는 통제권이 있는 국가 정보 및 자유 위원회(CNIL)에 이의 신청을 할 권리가 있다.

조항 9. 분쟁

9.1  경쟁부문에 참가하고 출품 시 규정에 동의란을 선택하는 것은 출품규정을 전면적으로 승낙하는 것을 의미한다.

9.2  경쟁부문 마감 후 두 달이 초과한 경우, 단편 경쟁에 관한 어떠한 요구나 주장도 받아들여질 수 없다.

9.3  본 출품규정은 프랑스 법에 따른다. 본 규관의 적용, 실행 또는 해석에 동의하지 않고 합의를 이루지 못한 경우 모든 분쟁은 주최자 본부(프랑스)의 법원에 따른다.
